4102.1 Purpose
4102.1.1 The School Board of Harrison County, West Virginia, is committed to protecting
its students from harassment, intimidation, or bullying for any reason and of any type. The
School Board believes that all students are entitled to a safe, secure, positive, productive,
nurturing, equitable, and harassment-free educational environment. Therefore, the purpose
of this policy is to prevent all forms of harassment, intimidation, or bullying, to protect the
educational environment, to assure the prompt and efficient response to such incidents, and
to deter future incidents from occurring. The Harrison County Board of Education shall not
tolerate acts of harassment, intimidation, bullying on school property, on a school bus, at a
school bus stop, or at school sponsored events or at any other location, whether or not on
school property, which may interfere with any student’s right to a harassment-free educa-
tional environment. Conduct that constitutes harassment, intimidation, or bullying, as de-
fined herein, is strictly prohibited.
4102.2 Definitions
4102.2.1 Harassment, Intimidation, and Bullying
As identified in WV Code 18-2C-2
and 18-2C-3
(a) As used in this article, “harassment, intimidation, or bullying” means any intentional
gesture, or any intentional electronic, written, verbal, or physical act, communication,
transmission or threat that:
(a) (1) A reasonable person under the circumstances should know will have the effect of
any one or more of the following:
(A) Physically harming a student;
(B) Damaging a student’s property;
(C) Placing a student in reasonable fear of damage to his or her person; or
(D) Placing a student in reasonable fear of damage to his or her property;
(b) (2) Is sufficiently severe, persistent, or pervasive that it creates an intimidating,
threatening or emotionally abusive educational environment for a student; or
